ABOUT SOUNDS OF BUFFALO
We're looking for talented Western New York musicians to select and have perform as the opener for Western New York’s premier awards show – the 2021 Excellence In Education Awards. See Rules and Regulations below.

SOUNDS OF BUFFALO is a celebration of talented musicians who live in Western New York. Our 2021 Excellence In Education Award opening performer will be chosen by the public on the Excellence In Education Awards Buffalo Facebook page. The winning musician or band will be rewarded by performing as the opener during the 2021 Excellence In Education Awards telecast to be shown on WBBZ-TV, and simultaneously on Facebook. SOUNDS OF BUFFALO is an initiative brought to you by Friends For A Better Buffalo. Enter and voted on at the Excellence In Education Awards Buffalo Facebook page. The SOUNDS OF BUFFALO competition is open to residents 18 years and older with residence in Western New York. The genre of song must be in English.

Musicians/Bands must download their performance on the Friends for a Better Buffalo “Excellence In Education Awards Buffalo” Facebook page via Messenger. The Excellence In Education Awards Facebook page administrator will post the video upon approval of the Organizing committee for the community to vote by pushing the “Like” button.
The Organizing Committee may take up to 48 hours to review the recording for visual and sound testing before posting on the Excellence In Education Awards Buffalo Facebook Page.
The Organizing Committee will not be responsible for the audio/video quality and CD compatibility with the sound system.
All musicians are to dress appropriately for the performance. Indecent exposure is NOT allowed.
All participants agree and automatically grant permission to the Organizing Committee on the usage of their photographs and/or videos taken as well as printing of their names for advertising, promotional and publicity purposes.
The top two winners may be invited to FRIENDS FOR A BETTER BUFFALO events and functions for complimentary performances.
MUSICIANS/BANDS will not post any material to EXCELLENCE IN EDUCATION AWARDS BUFFALO Facebook Page that:
• infringes any intellectual property rights of third parties;
• contains obscene, defamatory, insulting, disparaging, hateful, harassing or threatening, offensive material;
• is fraudulent, deceptive or misleading;
• comprises solicitations of any kind;
• are in violation of any law or regulation;
• or otherwise unacceptable to the tone of FRIENDS FOR A BETTER BUFFALO “EXCELLENCE IN EDUCATION AWARDS”.
We reserve the right to remove any posts or block any user from posting on the Facebook page. Please understand that the comments posted to the Facebook page do not represent the opinions of FRIENDS FOR A BETTER BUFFALO.
Digital Millennium Copyright Act
FRIENDS FOR A BETTER BUFFALO respects the intellectual property rights of third parties and responds to allegations that copyrighted material has been posted, uploaded or shared on or through the EXCELLENCE IN EDUCATION AWARDS BUFFALO Facebook page (the Page) without authorization from the copyright holder in accordance with the safe harbor provided in the Digital Millennium Copyright Act (DMCA).
The DMCA provides recourse for copyright owners who believe that material appearing on the internet infringes their rights under U.S. copyright law.
DMCA Notice procedure
If you believe that any material on the Page infringes your copyright, you may send FRIENDS FOR A BETTER BUFFALO a notice requesting that the material be removed. The notice needs to contain the following information:
a) A description of the copyrighted work that you claim has been infringed.
b) Identification of the URL or other specific location that contains the material that you claim infringes your copyright sufficient to allow FRIENDS FOR A BETTER BUFFALO to locate the allegedly infringing material.
c) A physical or electronic signature of the copyright holder or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
d) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law.
e) A statement by you that the information contained in your notice is accurate and that you are the copyright owner or that you are authorized to act on the owner's behalf.
f) Your name, mailing address, telephone number, and email address.
g) If you believe in good faith that a notice of copyright infringement has been wrongly filed by the Provider against you, the DMCA permits you to send the Provider a counter-notice. Notices and counter-notices must meet the current requirements imposed by the DMCA; see http://www.loc.gov/copyright/ for details.

Upon receiving a notice that meets the requirements set out above FRIENDS FOR A BETTER BUFFALO will remove the allegedly infringing material. We will also advise the alleged infringer of the DMCA Counter Notice Procedure described below by which the alleged infringer may respond to your claim and request that we restore this material.
DMCA Counter notice procedure
If you believe your own copyrighted material has been removed from the Page in error, you may submit a written Counter Notice to our designated agent identified above that includes the following information:
a) Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
b) A statement that you consent to the jurisdiction of the Federal District Court in which your address is located, or if your address is outside the United States or any other judicial district in which FRIENDS FOR A BETTER BUFFALO may be found.
c) A statement that you will accept service of process from the party that filed the notice or the party's agent.
d) Your name, address and telephone number.
e) A statement that you have a good faith belief that the material in question was removed as a result of mistake or misidentification of the material to be removed or disabled.
f) Your physical or electronic signature.
g) If you send our designated agent a valid, written counter notice meeting the requirements described above, we will restore your removed or disabled material within 10 to 14 business days from the date we receive your counter notice, unless our designated agent first receives notice from the party filing the original notice informing us that such party has filed a court action to restrain you from engaging in infringing activity related to the material in question.
h) Please note that if you misrepresent that the disabled or removed content was removed by mistake or misidentification, you may be liable for damages, including costs and attorney's fees.
Repeat infringer policy
In accordance with the DMCA and other applicable laws, FRIENDS FOR A BETTER BUFFALO will, at our discretion, disable and/or terminate access to the Page by users who may infringe or repeatedly infringe the copyrights of others
By submitting personal information for registration, all participants acknowledge that they have read through the competition Rules & Regulations and consent to allow the Organizing Committee to use all personal information for administrative purposes and data analysis. All personal data provided will be kept confidential at all times.
The Organizing Committee reserves the right to change any of the rules and regulations without prior notice.
The Organizing Committee reserves the right to disqualify any contestant if he/she does not adhere to any of the above rules and regulations.
Step 1. Post your singing performance to the Excellence In Education Awards Buffalo Facebook Page by March 31st, 2021.
Step 2. The Committee will review each submission and the number of likes. If approved, your submission will be viewed on the Friends for a Better Buffalo, "2021 Excellence In Education Awards", Facebook Page.
Step 3. The top two performances will be announced and notified the first week in April 2021.
Just win and your song will be used during the Friends For A Better Buffalo, "2021 Excellence In Education Awards", show on WBBZ on Sunday, May 2, 2021.
